Terms of Service

Effective Date: March 5, 2026

1. Agreement to Terms

By accessing or using the King Intelligence Social Media Machine (“Service”), operated by King Intelligence LLC (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

The Service provides an automated social media content pipeline. You upload video or photo content, and our AI-powered system generates platform-optimized posts, captions, and schedules publishing to your connected social media accounts via third-party integrations.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately of any unauthorized access.

4. Pricing and Payment

The Service offers a one-time trial fee and a recurring monthly subscription. Current pricing is displayed during checkout. All fees are charged in US dollars via Stripe. Subscription fees are billed monthly and are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice.

5. Your Content

You retain ownership of all content you upload (“Your Content”). By uploading content, you grant us a limited, non-exclusive, worldwide license to process, store, and distribute Your Content through the Service solely for the purpose of providing the Service to you.

You represent and warrant that (a) you have all necessary rights to Your Content, (b) Your Content does not infringe, misappropriate, or violate any third party's intellectual property rights, rights of publicity, or rights of privacy, and (c) Your Content complies with all applicable laws and regulations.

6. AI-Generated Content

6.1 Nature of AI Outputs

The Service uses artificial intelligence, including third-party AI models, to generate captions, hashtags, images, and content suggestions (“AI Outputs”). You acknowledge that: (a) AI Outputs are generated by machine learning systems and may contain inaccuracies, errors, or content that is not appropriate for your intended use; (b) AI Outputs may not be unique and the Service may generate the same or similar content for other users; (c) AI Outputs may not qualify for copyright protection under current U.S. Copyright Office guidance, and we make no representation regarding your ability to obtain intellectual property protection for AI Outputs; and (d) AI Outputs do not represent the views or endorsement of King Intelligence LLC.

6.2 Your Responsibility

You are solely responsible for reviewing, editing, and approving all AI Outputs before publication. By pressing “Approve” or “Post Now,” you accept full responsibility for the content as published, including compliance with all applicable laws, regulations, advertising standards, and social media platform rules. You must ensure that AI Outputs do not contain false claims about your products or services, infringe any third party's intellectual property rights, or violate any applicable advertising or consumer protection laws, including FTC guidelines.

6.3 AI Disclosure

You acknowledge that certain social media platforms (including but not limited to Meta, TikTok, and YouTube) require disclosure when content is AI-generated or significantly AI-altered. You are solely responsible for complying with all applicable AI disclosure requirements of the platforms to which your content is published. We recommend that you disclose the use of AI in content creation where required or appropriate.

6.4 No Warranty on AI Outputs

AI Outputs are provided “as is” without warranties of any kind, whether express or implied. We do not warrant or represent that AI Outputs will be accurate, complete, original, non-infringing, or suitable for your intended use. We do not accept any liability or responsibility arising from your use of AI Outputs or any errors, omissions, or inaccuracies contained in AI Outputs. Use of AI-generated content is at your own risk.

6.5 Third-Party AI Services

The Service relies on third-party AI models and services to generate content. Your content inputs may be processed by these third-party providers in accordance with their respective terms and privacy policies. We do not control these third-party AI models or their updates, and we are not responsible for changes in their behavior or output quality.

6.6 Prohibited AI Content Uses

You agree not to:

  • Represent AI Outputs as being wholly generated by a human without AI assistance
  • Use AI Outputs to generate fake reviews, testimonials, or endorsements
  • Use AI Outputs for political advertising or election-related communications
  • Use AI Outputs to create content that is defamatory, fraudulent, or deceptive
  • Use AI Outputs in any manner that violates applicable law

7. Third-Party Services

The Service integrates with third-party platforms (social media networks, video processing APIs, payment processors). Your use of these third-party services is subject to their own terms and policies. We are not responsible for the availability, actions, or policies of third-party services.

8. Prohibited Uses

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload content that infringes on intellectual property rights
  • Upload harmful, abusive, or objectionable content
  • Attempt to reverse-engineer, exploit, or disrupt the Service
  • Share your account credentials with unauthorized parties

9. Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months. Upon cancellation, your account will be deactivated and your data may be deleted after 30 days.

10. Indemnification

You agree to indemnify, defend, and hold harmless King Intelligence LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) Your Content or any content you approve and publish through the Service; (b) your use of AI Outputs, including any intellectual property infringement, defamation, false advertising, or regulatory violations resulting from content you approved and published; (c) your breach of these Terms; (d) your violation of any applicable law, regulation, or third-party right; or (e) any dispute between you and a third party regarding content published through the Service.

11. Limitation of Liability

To the maximum extent permitted by law, King Intelligence LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, business opportunities, goodwill, or revenue, whether based on warranty, contract, tort (including negligence), or any other legal theory.

To the maximum extent permitted by law, King Intelligence LLC's total aggregate liability arising out of or in connection with these Terms or your use of the Service shall not exceed the amounts you have paid to us for the Service during the three (3) month period immediately preceding the event giving rise to the claim, or one hundred dollars ($100), whichever is greater.

The limitations in this section apply regardless of whether we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Disclaimer of Warranties

The Service, including all AI-generated content, is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties, including without limitation, warranties of merchantability, fitness for a particular purpose, title, non-infringement, and quiet enjoyment. We do not warrant that the Service will be uninterrupted, error-free, or secure, that AI-generated content will be accurate, original, or non-infringing, or that the Service will achieve specific engagement, reach, or business outcomes.

13. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or in-app notice. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Summit County, Ohio.
